Mobile voice and SMS recording has been mandatory for certain staff within regulated firms since 2011, when the FSA published its Policy Statement 10/17. However, since the introduction of MiFID II in January 2018, this requirement now applies to a far greater cross-section of the financial sector.

Under MiFID II, all communications relating to activities intended to result in the conclusion of a transaction or the provision of client order services, even if they don’t result in a financial transaction, now need to be recorded and stored for a minimum of 5 years (or up to 7 years if requested).

To facilitate this, we offer a range of mobile recording solutions designed to help firms remain compliant with all applicable regulations, including the original 2011 FSA Policy Statement 10/17, FCA SYSC 10A, MiFID II, FINRA, CFTC, SEC and Dodd-Frank regulations, without the need for any new infrastructure.

MOBILE RECORDING SOLUTIONS

With many of our clients working in the Financial Services sector, we understand that there is no one-size-fits-all mobile call recording system. Operational and compliance policies and infrastructure vary from company to company.

Some firms operate, or plan to move to, a BYOD policy, while others adopt a strictly corporate-mobiles-only stance. Some organisations are primarily or solely UK-based, while others have a more global reach. In certain companies, one operating system may be favoured over another… And some businesses may just simply prefer one type of recording solution over another.

With this in mind, in order to provide the best fit for each individual requirement, we provide a full range of mobile call recording options: SIM-based, app-based and network-based, as well as alternative options using recorded cloud VoIP systems and recorded Microsoft Teams deployments which, unlike traditional mobile recording solutions, do not rely on CAMEL network availability (“Customized Applications for Mobile networks Enhanced Logic”) when users are roaming abroad.

App-Based Mobile Recording

APP-BASED MOBILE RECORDING

A mobile recording application is installed on user’s iOS or Android device. A second phone number is associated to the app, providing a “dual persona”. All calls and SMS made to or from the app (business communications) are recorded, while personal communications using the phone’s native dialler remain private.

Features:

  • Network agnostic – no need to change mobile carrier or SIM card
  • Works on any Android and iOS device
  • Employees use app with second number for business communications
  • Overseas numbers available for users based in certain countries outside the UK
  • Dual persona allows personal communications to remain private

Limitations:

  • Use of a new second number for business communications may be undesirable for some firms
  • Relies on CAMEL network availability when roaming
  • Users must ensure the app is used for all work-related communications

Use Case:

  • App-based mobile recording is ideally suited to firms with BYOD policies in place and/or whose employees use their mobiles for both business and personal communications, allowing work-related calls to be recorded while maintaining GDPR compliance. It also provides a solution to firms who are unable to change their mobile provider (e.g. if they are tied into contract).

NETWORK-BASED MOBILE RECORDING

Carrier-level mobile recording using the phone’s native dialler, with no need for any applications to be downloaded. All calls and texts made and received are captured and archived at network level.

Features:

  • Uses phone’s native dialler
  • No “user choice” – all communications recorded
  • No apps to install
  • Lower roaming charges than SIM-based mobile recording options
  • No need to change existing phone numbers

Limitations:

  • Porting of phone numbers to a different network potentially required
  • Relies on CAMEL network availability when roaming
  • All communications recorded so unsuitable if personal calls are being made or received on user’s device
  • Setup may be cost-prohibitive for smaller deployments

Use Case:

  • Network-based mobile recording solutions are ideal for larger firms who issue staff with corporate devices which are used solely for business purposes, particularly where staff roam outside of the UK

SIM-BASED MOBILE RECORDING

SIM-based mobile recording uses a Mobile Virtual Network Operator (MVNO) to carry calls and texts. Calls are made and received from the device’s native dialler, with no need for any applications to be downloaded. All calls and texts made and received are captured.

Features:

  • Uses phone’s native dialler
  • No “user choice” – all communications recorded
  • No apps to install
  • Lower setup charges than network-based mobile recording options
  • No need to change existing phone numbers

Limitations:

  • Change of SIM cards and mobile provider required
  • Relies on CAMEL network availability when roaming
  • All communications recorded so unsuitable if personal calls are being made or received on user’s device
  • Roaming costs outside the UK & Europe can be very high

Use Case:

  • SIM-based mobile recording solutions can provide a good fit for firms looking to avoid large setup costs, where employees use company-issued phones for business purposes only and do not travel outside the UK/Europe.

CLOUD/UC-BASED CALL RECORDING

While not a mobile recording solution in the traditional sense, since calls are not passed over mobile networks, cloud-based VoIP telephone systems and Unified Communications platforms offer an entirely different approach to recording employees’ calls while away from their office.

Since early 2020, remote working has become a way of life for many businesses. Staff whose calls would normally be captured by their office’s call recorder are now working from home. For regulated firms using legacy on-premise phone systems, this causes a problem.

Hosted phone systems however, as well as UC platforms such as Microsoft Teams, offer an elegant and cost-effective solution. With a VoIP phone system hosted in the cloud, employees can use it from anywhere – not just the office -and from any device, including mobiles and PCs.

Connected to a cloud-based call recorder, this allows workers to use their existing desk phone numbers to make and receive calls via a UC app on their mobile (or laptop) and work compliantly from any location.

Features:

  • Calls routed over data and PSTN instead of mobile networks
  • Can be deployed without change of existing supplier or phone system
  • Does not rely on CAMEL network availability when roaming
  • Calls break out from UK even when roaming
  • Free calls to on-net users from same organisation
  • No need for new phone numbers
  • Allows separation between personal and business communications
  • Can be used with personal or corporate-issued devices
  • No setup charge
  • Rapid deployment

Limitations:

  • As a VoIP solution using fixed line networks, this is unsuitable for SMS capture
  • Relies on data connectivity to make and receive calls (4G/WiFi)
  • When calling from a mobile phone, employees must use the UC app for calls to be recorded

Use Case:

  • UC-based call recording is perfect for firms who require a robust, flexible, easily scaleable and cost-effective way to meet compliance recording obligations while employees are working remotely…provided that their users do not rely on SMS messaging.

E-DISCOVERY AND SURVEILLANCE

Each of these solutions is available as a standalone service. However, capturing mobile communications is only part of the picture. Recordings not only need to be stored but must also be easily searchable and retrievable for compliance with regulations such as MiFID II.

In order to be used as proactive, preventative surveillance tools, they must also be able to provide real-time alerts on any “red flag” communications that meet predefined criteria.
