Mobile voice and SMS recording has been mandatory for certain staff within regulated firms since 2011, when the FSA published its Policy Statement 10/17. However, since the introduction of MiFID II in January 2018, this requirement now applies to a far greater cross-section of the financial sector.
Under MiFID II, all communications relating to activities intended to result in the conclusion of a transaction or the provision of client order services, even if they don’t result in a financial transaction, now need to be recorded and stored for a minimum of 5 years (or up to 7 years if requested by the National Competent Authority in a certain country).
